TRADERS TERMS & CONDITIONS

WHAT YOU NEED TO KNOW

1. Introduction

The Barrowland has served as a cornerstone of Glasgow’s cultural and commercial life for generations. Margaret McIver Limited (MML), as steward of this legacy, is committed to ensuring that all trading activity reflects the values, safety standards, and community spirit that define the markets. These policies set out the expectations, responsibilities, and conditions under which stallholders may trade within our estate.

MML is committed to fostering a welcoming, respectful, and inclusive environment across all parts of our businesses such that stallholders, staff, visitors, and partners are treated fairly and with dignity.

This document forms part of the “Licence to Occupy” and applies to all Stallholders.

2. Governance and Compliance

All Stallholders must comply with the Civic Government (Scotland) Act 1982, including Section 112 Management Rules; all relevant Acts, Bylaws, Statutory Instruments, and City of Glasgow regulations; Trading Standards, Consumer Protection, Environmental Health, and Health & Safety requirements; any public health guidance in force; and all operational instructions issued by the Market Manager or authorised MML representatives, with approval to trade remaining at the sole discretion of MML and subject to withdrawal at any time.

3. Registration Requirements

Stallholders must provide and keep uptodate their name, trading name (if applicable), address, telephone number, email address, company number (if applicable), and a description of the goods or services they offer and must report any changes promptly to the Market Office.

4. Trading Hours

Stallholders agree to trade on Saturdays from 10:00 to 16:00, on Sundays from 10:00 to 16:00. Stalls must be open, staffed, and trading during these hours unless otherwise agreed in writing.

5. Fees and Payment

Popup Stallholders must pay in full before trading, and their licence to occupy ends at the close of business on the relevant day; all other Stallholders must pay the fees set by MML in full and on time, with fees remaining payable unless notice of termination is given in accordance with section 10, and failure to pay may result in immediate suspension or withdrawal of trading rights. Such withdrawal does not result in a refund and does not remove the obligation to pay rent up to the date of termination.

6. Stallholder Obligations

6.1 Operational Standards

Stallholders must trade only within their allocated stall area, keep the stall clean, tidy, and safe at all times, display prices clearly and trade honestly, remove all waste to designated disposal points, report hazards, accidents, or suspicious activity immediately, follow all instructions from market staff, security, and emergency services, ensure all electrical equipment is safe and PATtested where required, and comply with all Environmental Health requirements if trading in food.

6.2 Conduct

Stallholders must not cause nuisance, obstruction, or disturbance; engage in behaviour that undermines the reputation or safe operation of MML; sublet or share their stall without written permission; or engage in any conduct that is discriminatory, intimidating, or offensive.

6.3 Prohibited Goods and Other Restrictions

The following goods are strictly prohibited: illegal, stolen, counterfeit, or unsafe goods; firearms, air guns, BB guns, knives, offensive weapons, laser pens, or replicas; fireworks, explosives, inflammable liquids, or hazardous chemicals; alcohol, intoxicating substances, cigarettes, vapes, or tobacco; and goods containing sectarian, political, or religious content likely to cause offence.

Generators, gas cylinders, or non-standard electrical equipment may not be used without prior written approval.

7. MML Obligations

MML will provide stallholders with access to their stall an hour before and after agreed trading hours and during regular Market Office business hours (i.e., Monday to Friday, excluding holidays) subject to checking in with the office, maintain common areas in a safe and orderly condition, give reasonable notice of operational changes, closures, or inspections, and ensure shared facilities are cleaned as required.

Security is provided on site; however, Stallholders are responsible for securing their own stock. Shutters must be closed and locked when the stall is unattended. MML is not liable for loss, theft, or damage unless caused by negligence.

8. Health & Safety

Stallholders must comply with all fire safety requirements, follow emergency procedures, and adhere to instructions from market staff, security, and local authorities.

9. Damage and Indemnity

Stallholders are responsible for any damage caused to the stall, fixtures, or market property, and for indemnifying MML against any claims arising from their activities.

10. Termination

MML may suspend or terminate the licence immediately for breach of terms, unsafe trading, illegal activity, or nonpayment, or with 7 days’ notice for operational or estatemanagement reasons; the Stallholder may terminate the licence with 21 days’ written notice unless otherwise agreed, and breaches may result in immediate removal from the market, withdrawal of trading rights, or temporary or permanent bans, with all management decisions being final.

11. No Tenancy

This licence grants permission to occupy only and does not create a lease, any form of security of tenure, or any rights under the Housing (Scotland) Acts or commercial leasing law.

12. Data Protection

Personal data will be processed in accordance with GDPR and used solely for market administration and estate management.

13. Notices

Notices can be via email, hand delivered or recorded mail.

14. Acceptance

By booking, paying for, or occupying a stall, the Stallholder confirms acceptance of terms and conditions and agrees to comply fully with all requirements set out herein.
